The use of video wills in court have become prudent legal practice both for the attorney and for the Testator (one who makes and executes their will). The reasons are sound.
1. A video will is a simultaneous recording of both audio and visual events which clearly show the Testator mental and physical state of being. A video will clearly show Testators state of mind, and will minimizes challenges to the will itself.
2. A videotaped will correctly depicts those persons present at the signing of the will.
It is suggested that any beneficiary to the will not be present during the will ceremony.
3. The videotape will show that the testimony was voluntarily made without any type of improper inducement. This is an area where a non-video will is lacking.
4. There is a growing recognition among the legal system that videotape wills convey a greater indicia of reliability than audio testimony of the event itself. (Roy v.State,608SW.2d 645,649 [Tex,Crum.App.1980].
5. A videotaped will by a certified professional, disinterested third party, is the most effective method of preserving testimony or reconstructing an event when it comes to presenting visual evidence in court.
6. As a Certified Court Videographer with the American Guild of Court Videographer,(CCV), I'm a licensed certified professional who understands the Federal Rules of Civil Procedure 30(b)(4), which governs the taking of videotaped events to be admitted in a court of law.
7. If you believe that relatives or beneficiaries might want to challenge your will after your death, by all means have your will videotaped. Make sure your true intentions are followed.
8. A video will provides quick and easy access to your loved ones after you have past. As a VIDEO WILL with time-date code generation, there is less likelyhood of challenges to your video because the legal video will helps eliminates claims that the tape was spliced, erased or otherwise altered.
9. Remember, as a Certified Court Videographer, I will be present to testify in court as to the validity of your video. A friend or relative would not have this type of standing in a court of law.
